Court of Appeal just delivered a well researched judgment, which they anchored on the separation of power between the three arms of government in the matter Hon. Justice Ngajiwa vs. FRN. They said EFCC does not have power to investigate and prosecute serving judicial officers without first being dismissed by NJC That serving judicial officers can only be prosecuted for offences like murder, stealing etc done outside the discharge of their duties. That once the offence was committed in the discharge of their duties, they must be tried by NJC first and dismissed before EFCC can investigate or prosecute them. Embattled former National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh, has asked the Federal High Court in Abuja not to set aside the subpoena it issued to compel former President Goodluck Jonathan to appear as a witness in his ongoing trial. Metuh further challenged Jonathan’s insistence that the defendant must deposit with the court, for and on behalf of himself, the sum of N1billion in line with provisions of Section 241(2) of the Administration of Criminal Justice Act, 2015, before he would mount the witness box.
